Conditional Waiver and Release on Progress Payment

Cal. Civ. Code § 8132

Section 8132 sets out this form for a waiver and release given in exchange for, or to induce, a progress payment where the claimant is not in fact paid in exchange for it, or where a single payee or joint payee check is given in exchange for it.

Unconditional Waiver and Release on Progress Payment

Cal. Civ. Code § 8134

Section 8134 sets out this form for a waiver and release given in exchange for, or to induce, a progress payment where the claimant asserts in the waiver that it has in fact been paid the progress payment. The statute requires the Notice to Claimant to be in at least as large a type as the largest type otherwise in the form.

Section 8136 sets out this form for a waiver and release given in exchange for, or to induce, a final payment where the claimant is not in fact paid in exchange for it, or where a single payee or joint payee check is given in exchange for it.

Section 8138 sets out this form for a waiver and release given in exchange for, or to induce, a final payment where the claimant asserts in the waiver that it has in fact been paid the final payment.
